Copyright infringement

This website was developed by the Digital Library for Earth System Education (DLESE) with funding from the National Science Foundation. Views expressed in this website do not necessarily reflect the views of DLESE, or any of its sponsors or affiliates.

Use

The user is granted the right, without any fee or cost, to access, link to and use, publish, distribute, disseminate, transfer, or in any manner alter, modify, revise, copy, edit, or digitize, for any non-profit training, research, or educational purpose whatsoever and not for any direct or indirect commercial purpose or advantage. Any copyright notice contained in this Disclaimer Notice or in any other part of this website shall remain intact and unaltered and shall be affixed to any use or copy of all or any such part of this website. The user must include an appropriate citation crediting the source of all or any portion of this website as follows:

Users may contribute comments, reviews, metadata, URLs, or other information to the DLESE website and send emails and other communications, so long as the content is not illegal, obscene, threatening, defamatory, an invasion of privacy, infringing of intellectual property rights or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."  The user may not use false email addresses, impersonate any person or entity, or otherwise mislead as to origin of any communication, message or other content. DLESE and UCAR reserve the right (but not the obligation) to remove or edit such content, but do not regularly review posted content.

If the user does contribute comments, reviews, metadata, or other information, the user voluntarily grants DLESE or UCAR or its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and full right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the contribution throughout the world in any media. The user grants DLESE and UCAR or its affiliates the right to use the name (if any) that the user submits in connection with such contribution, if the user so chooses. In the case where attribution is made to the contributor of original material (e.g. reviews, messages on listservs/email groups, and other comments), DLESE will not alter such content. However, contributed metadata (resource descriptions, subjects, resource types, etc.) may be changed to enhance resource description and discovery.

To the best of the user's knowledge, use of the contribution by DLESE does not violate any intellectual property rights and will not cause injury to any person or entity. DLESE, UCAR, or its affiliates, have the right, but not the obligation, to monitor and edit or remove any activity or contribution. DLESE or UCAR or its affiliates take no responsibility and assume no liability for any contribution made by the user or a third party.

By visiting DLESE, the user agrees that the laws of the state of Colorado and the United States of America, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute that might arise between the user and DLESE, UCAR, or its affiliates. By visiting and using this website, the User agrees to abide by all laws of the United States of America, including any applicable export control laws regarding the use of any or all parts of this website.

Notification of copyright infringement

DLESE will, in appropriate circumstances, terminate the accounts of users who infringe the intellectual property rights of others. If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on this website or on sites linked to from this website, please provide DLESE's Copyright Agent a Copyright Infringement Notification.  Subscribers who feel that an infringement notification has been filed in error may complete and submit a Copyright Infringement Counter Notification. 

The Digital Millennium Copyright Act requires that all notices of alleged copyright infringement be in writing.  For DLESE to act on your notice, you must be authorized to enforce the copyrights that you allege have been infringed.  When informing DLESE of an alleged copyright infringement, you should:

  1. Identify the copyrighted work that allegedly has been infringed.  If multiple copyrighted works at a single online site are involved, please provide a representative list of such works on that site.
  2. Describe the material that is claimed to be infringing and provide sufficient information to permit DLESE to locate that material. 
  3. Provide your contact information, including an address, telephone number, and, if available, an e-mail address. 
  4. Certify or include a statement that you have a good faith belief that the use of the copyright-protected material in the manner complained of is not authorized by the copyright owner, the owner's agent, or law. 
  5. Certify that the information that you have provided DLESE is accurate.  You should attest under penalty of perjury that you are authorized to enforce the copyrights that you allege have been infringed.
  6. Include your physical or electronic signature. 

DLESE may not be able to act on your complaint promptly or at all if you do not provide this information.
